Decision of Supreme Court of Pakistan (SCP) on Jirga/Panchayat on NCSW petition

NCSW challenged the jirga/panchayat and other such forums  in the Supreme Court of Pakistan in 2011.  The Supreme Court   of Pakistan on 16th Jan 2019 declared jirga/panchayat etc illegal and against the spirit of the Constitution of the Pakistan.

This landmark Judgment will curb violence against women and illegal practices of honor killings, vanni, swara, karo kari, etc., that are not only violative of the fundamental rights of women under the Constitution but are also against the basic human rights guaranteed under the international conventions that Pakistan is signatory to in this regard, particularly the Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW).

The Commission has also sent letter dated 31st January, 2019 to all provincial IGP’s including ICT to know that whether any measures have been taken in this regard particularly in connection with formulation of SOPs in the light of the judgment, to avoid occurrence of such incidents in future.

The Commission has received response from IGPs of Balochistan, Sindh and ICT regarding its implementation and formulation of SOPs.
